Withholding Mail

    pro2A Hell, It's about time!

We moved into our new place on the 1st of August, and we did a change of address shortly there after. The post office said no new mail would be delivered to our old address, and I even put a "house vacant" sign on the mailbox before we left. Our ex-landlord is a little nutty... so I made sure the post office understood not to deliver to our old address.

A few days later we get a call from the property manager saying we can get our mail at the office once we return the garage door opener  stupid shit right....

Again we call the post office and tell them "do not deliver to our old address, our ex-landlord is nuts and taking our mail". The lady on the phone was nice and said she'd put a note to both our past and current carriers that we have moved and had filed a change of address. Do not deliver to the old address.

The next day I go over to the old place to find the sign on the mail box taken down, presumably by the crazy ex-landlord. Now here we are on the 21st and we have recieved very little forwarded mail. We have changed our address with our cell phone carrier, TV, internet, credit cards, NRA, magazines etc... There is stuff we should have had in that period of time that we think got sent to the old address and she is withholding for whatever reason. We are paid up on rent, the house was clean etc... she is just mad because we left and left her high and dry on the mortgage. She was a little nuts about that. I want our mail, can she legally hold it and what can I do legally?

Thats some pretty heavy schtuff to hold mail. Last I recall that involves Federal Authorities.

    U.S. Laws on Direct Mail

maybe that can help you a bit

I thought it was a federal felony...., but how do I prove she is taking it within reason? I'm not going to set up cameras or camp out in the yard all day and wait... I need some way to prove she has it. It doesn't take a rocket scientist to figure out its her. She used to take previous tenants mail when we moved in and held it too.

I'd just contact your local Postal Inspector, tell He/She that you have a firm reason to believe your previous landlord is withholding your mail. Mention that you've gone through all the proper steps on your side when it comes to changing your address and all the other responsible precautions you did.

Hopefully the PI will be able to give the landlord a nice dosage of shock treatment with a few threats of that lofty fine.

Well the big thing is it wouldnt take much for the Landlord to come up with some bogus story about you threatening her. Thats sorta why my best advice would be to just let a badged authority handle the dirty stuff. They can get away with the threats alot better than we can ;)

what's with all these ex landlords keeping mail these days. it's all over the place. they need to get a grip and I could've swore that it was a felony to hold ones mail too.
